This Consumer Health Data Notice (“Notice”) supplements the Privacy Policy of AMELIA HQ, LLC (“Company,” “we,” “us,” or “our”) for BUSTMOB.COM, the related mobile application, GoalFinder, photo galleries, community features, events, store, and related services (collectively, the “Services”). This Notice applies only to a consumer, and only to information concerning that consumer, to the extent an applicable consumer-health-data law requires Company to provide this Notice or grants the consumer a right described in this Notice.

This Notice does not create rights, obligations, or contractual commitments for any person or information not subject to an applicable consumer-health-data law, and it does not expand Company’s obligations beyond those imposed by applicable law. If this Notice conflicts with the Privacy Policy as to information subject to an applicable consumer-health-data law, this Notice controls only to the extent required by that law.

1. Scope and Definition

For purposes of this Notice, “Consumer Health Data” or “CHD” means only information that is “consumer health data,” or a substantially similar defined term, under the consumer-health-data law applicable to the particular consumer and information at issue. The scope of CHD, and whether a consumer has any right described in this Notice, is determined under that applicable law.

For example, information may be CHD under a state law if it is linked or reasonably linkable to a consumer and identifies, or is used to identify or infer, the consumer’s past, present, or future physical or mental health status, health-care seeking, treatment, procedure, or recovery. Information is not treated as CHD under this Notice solely because it concerns appearance, fashion, cosmetic interests, body characteristics, or use of the Services, unless applicable law treats that information as CHD in the context at issue.

To the extent information qualifies as CHD under an applicable consumer-health-data law, CHD may include:

  • Information you choose to provide about a cosmetic or surgical procedure, consultation, provider, treatment, recovery, symptoms, outcome, complication, medication, or health-related concern;
  • Photographs, videos, captions, before-and-after materials, and other user content only to the extent they identify or reasonably permit an inference about a procedure, treatment, recovery, or health status;
  • Procedure-related searches, GoalFinder filters, browsing activity, and interactions only to the extent they identify or reasonably permit an inference that you are seeking, receiving, considering, or recovering from health care or a procedure;
  • Age, height, weight, bra size, clothing size, or other body or outcome descriptors only when linked with procedure-related information in a manner that identifies or reasonably permits an inference about health status or health-care seeking;
  • Messages, posts, event questions, support communications, and reports only to the extent they contain information described above;
  • Location information only to the extent it identifies or reasonably permits an inference about seeking or receiving health care or health-related services; and
  • Health-related inferences generated from the foregoing information, if any.

CHD does not include de-identified information, aggregate information, or information otherwise excluded from applicable consumer-health-data laws, provided that Company does not attempt to reidentify information except as permitted by law.

2. Categories, Sources, and Purposes

The provisions in this Section apply only to the extent required by an applicable consumer-health-data law.

A. Categories We May Collect. We may collect the CHD categories described in Section 1, but only to the extent applicable to the features you use and the information you elect to submit, make visible, search for, or otherwise provide through the Services.

B. Sources. We may collect CHD directly from you when you create or complete a profile; use GoalFinder; search, filter, post, comment, message, upload media, join community features, contact us, make purchases, register for events, or otherwise use the Services. We may also receive CHD from other users when they submit content concerning you, from service providers acting solely on our behalf, and from third-party services when you choose to connect, interact with, or direct them to share information with us, subject to applicable law.

C. Purposes. We may collect and use CHD only as reasonably necessary and proportionate to:

  • Provide, operate, secure, maintain, personalize, and improve requested Services, including community, GoalFinder, photo-gallery, store, and event functions;
  • Display content according to your settings and the functionality you choose to use;
  • Enable user-requested searching, filtering, community interaction, customer support, and communications;
  • Moderate content; investigate reports; prevent fraud, abuse, unauthorized access, and violations of our terms; and protect users, Company, and others;
  • Comply with law, respond to lawful process, establish or defend legal claims, enforce agreements, and preserve records; and
  • Carry out another purpose specifically disclosed to you and, when required, supported by separate affirmative consent.

3. Sharing; Sale; Advertising

We may share CHD only as permitted by applicable law and, where required, with your separate affirmative consent. Depending on the context, recipients may include:

  • Service providers that host, secure, maintain, support, moderate, communicate for, process payments for, fulfill orders for, or otherwise provide services to Company under binding instructions and confidentiality and security obligations;
  • Other users or the public when you choose to submit content through a public, searchable, group, or otherwise visible feature, or otherwise direct us to disclose it;
  • Professional advisers, insurers, governmental authorities, courts, law enforcement, and others when reasonably necessary for legal compliance, safety, security, fraud prevention, enforcement, or protection of rights; and
  • Successors or affiliates in connection with a corporate transaction or internal business administration, subject to applicable law.

4. Consent and Withdrawal

You may withdraw a consent through support@bustmob.com, subject to legal, security, and operational limits. Withdrawal does not affect collection, use, or sharing that occurred before withdrawal, nor does it require Company to delete information where retention is permitted or required by law. We will not deny you Services or otherwise retaliate against you for exercising a right under applicable law, except to the extent a requested Service cannot reasonably be provided without the applicable information or consent.

5. Your Rights

If, and only to the extent, an applicable consumer-health-data law grants you a right with respect to CHD, and subject to verification and lawful exceptions, you may have the right to:

  • Confirm whether Company collects, shares, or sells CHD concerning you;
  • Access CHD concerning you, including information about third parties and specific affiliates with whom it has been shared where required by law;
  • Withdraw consent for the collection or sharing of CHD where consent applies;
  • Request deletion of CHD; and
  • Appeal a denial of a rights request where required by law.

To submit a request, use email support@bustmob.com. We may request information reasonably necessary to verify your identity and authority. We will respond within the period required by applicable law. If we deny a request and an appeal right applies, you may appeal by replying to the denial. Company will evaluate requests based on the consumer’s residence, the information at issue, the applicable law, and any lawful exception or limitation. The availability of a request channel does not mean that a particular consumer, data category, or request is subject to a consumer-health-data law or entitled to the rights described in this Notice.

6. Retention, Security, and Geofencing

We retain CHD only for as long as reasonably necessary and proportionate for the purposes described in this Notice, including to provide and secure the Services, meet legal, accounting, and reporting obligations, resolve disputes, enforce agreements, preserve evidence, and maintain secure backups. Retention periods vary based on the category of information, the feature used, legal obligations, security needs, and whether deletion is requested.

We use reasonable administrative, technical, and physical safeguards designed to protect CHD. No system is completely secure. If we determine that a security incident requires notice, we will provide notice as required by applicable law.

Company does not use a geofence around a facility that provides in-person health-care services to identify or track consumers, collect CHD, or send notifications, messages, or advertisements to consumers where prohibited by applicable law.

7. No Expansion of Legal Rights

Except to the extent required by applicable law, this Notice is not intended to, and does not, create any private right, contractual right, remedy, standard of care, fiduciary duty, or obligation exceeding applicable law. Company may apply protections described in this Notice voluntarily in particular circumstances, but a voluntary accommodation does not create a continuing obligation or waive Company’s right to determine the legal scope of this Notice in a future matter.

8. Changes and Contact

We may update this Notice when our practices or applicable law changes. If a change requires additional notice or consent, we will provide it before implementing the new practice. Questions and requests may be directed to support@bustmob.com.
